New Supreme Court filing fees from 1 October 2018

Effective today, the Supreme Court implements new fees payable under new regulations.

The changes introduce new rates for corporate, standard and concession fees.

  • 1) Corporate fees - these are the highest fees applicable, and apply to any entity which is not a standard fee or concession fee payer

  • 2) Standard fees - these are 50% of the corporate fees and apply to:

    • (a) a natural person other than a natural person acting in the capacity of a statutory office holder;

    • (b) an entity which is a not-for-profit organisation that

      • (i) operates exclusively for charitable, civil or other social purposes; and

      • (ii) does not share or allocate the funds or profits of the organisation with the owners, shareholders or executives of the organisation;

    • (c) any entity that has a turnover of less than $200,000 in the financial year before the financial year in which a fee needs to be paid;

    • (d) the executor or administrator of a deceased estate.

  • 3) Concession fees - capped to a maximum of $300

Commercial court fee changes

Notable changes in the commercial court fees include:

  1. The fee for a Summons for Directions or a Default Judgment is now included in the commencement fee.

  2. Winding up applications now have a unique commencement fee.

  3. There are new fees for nomination of a liquidator and warrants as well as hearing fees for second and subsequent interlocutory application hearing days.

  4. There are significant changes to trial and hearing fees including when they are due.

Court of Appeal fees

Court of Appeal fees include the new fee categories as well as distinct fees for matters arising from the Commercial Court.

Probate fees

The filing fees for filing an application for Probate and Letters of Administration is now calculated on a sliding scale based on the gross value of the deceased’s Victorian estate. Only the standard fee category is applicable.
